Filing and trying a case are different steps
A personal injury lawsuit does not automatically result in a courtroom trial. The parties may continue evaluating settlement while the case moves through litigation. In this video, attorney Norman Gregory Fernandez explains why preparation and negotiation can proceed together. No attorney can responsibly promise at the outset that a particular case will settle or that trial will be necessary.
Evidence changes the evaluation
Written discovery, documents and depositions can clarify responsibility and damages. Sometimes new evidence narrows a disagreement; sometimes it exposes a weakness or creates another dispute. Keep your attorney informed about treatment, work and contact details so the evaluation stays current. Preserve relevant information and respond carefully to requests for your assistance. Trial readiness depends on reliable evidence, not simply the fact that a lawsuit was filed.
Settlement discussions may continue
Negotiation and mediation can occur at different stages. Their timing depends on the case, the participants and court scheduling. A mediation offers an opportunity to explore resolution; it does not guarantee an agreement. Discuss proposed terms with counsel, including the release, fees, expenses and claims against the proceeds. The gross offer alone does not show what you will receive or what rights you will give up.
Understand the client’s decision
Your lawyer should explain significant strengths, weaknesses, practical recovery issues and the risks of continuing. The decision whether to accept a settlement belongs to the client. Ask questions and allow time to understand the recommendation and available alternatives. A desire to avoid court is understandable, but it should be weighed against the actual offer and evidence rather than a general fear or a promised result.
Prepare for the possibility of trial
When a case does not resolve, counsel must prepare the evidence and witnesses for the applicable court process. You may need to review records, prepare for testimony and arrange time away from work. Ask what participation is expected and what developments could change the schedule. Trial involves uncertainty, and careful preparation supports an informed decision whether to resolve the matter or proceed.
