Small early decisions can create lasting questions
After an accident, uncertainty and stress can make ordinary decisions difficult. This video addresses three common problems: losing evidence, delaying appropriate care and speaking without understanding an insurance request. None of these issues automatically determines a claim’s outcome. The goal is to protect your health and create an accurate record, not to build an artificial story for an insurer.
Mistake one: assuming evidence will remain available
Vehicles move, hazards are repaired and recordings may be overwritten. When safe, photograph the scene and preserve witness contacts, report information and damaged items. Save original files and messages. If you know of a nearby camera, record its location and tell your attorney promptly. Do not trespass, confront people or interfere with emergency responders to gather evidence.
Mistake two: minimizing symptoms or avoiding needed care
Obtain appropriate medical advice and describe your symptoms accurately. If pain develops later or an earlier condition changes, explain the timing honestly. Follow treatment recommendations or discuss barriers with your healthcare provider. If work, transportation or cost caused a gap, preserve the facts. Do not fabricate an explanation or assume that a gap automatically eliminates your ability to pursue a claim.
Mistake three: treating every insurance call the same
Identify the caller, company, claim and purpose of a request before answering detailed questions. Your own policy may impose cooperation duties, while another party’s insurer has a different role. Be truthful, avoid guessing and ask for clarification when you do not understand a question or authorization. Get advice about a recorded statement or release rather than relying on a universal rule to refuse all contact.
Correct the record with facts
Tell your attorney about missing evidence, earlier statements and treatment gaps promptly. Concealing an awkward fact can make it harder to evaluate the matter properly. Gather what remains available and provide an accurate timeline. Our firm offers a free consultation to discuss the evidence and next steps after a California accident.
