An early statement does not tell the whole story
Saying you felt fine at the scene does not, by itself, answer whether you were injured or whether you have a claim. The circumstances, later symptoms, medical findings and other evidence all matter. In this video, attorney Norman Gregory Fernandez explains why an automatic reassurance can become an issue when an insurer evaluates an accident. This article offers practical ways to give an accurate account without exaggerating or rewriting what happened.
Describe what you actually knew
Answer questions truthfully. If you are unsure whether you are hurt, say that you are unsure. Do not guess about a diagnosis or promise that you will not need care. Equally, do not claim symptoms you are not experiencing. A brief conversation at a stressful scene may have a different context from a later medical evaluation. Keep that context clear rather than assuming a particular phrase either proves or defeats your case.
Keep an accurate symptom timeline
If symptoms arise or change, obtain appropriate medical attention and tell the provider when you first noticed them. Write down the approximate time, what you experienced and how it affected ordinary activities. Distinguish what you remember from what you reconstructed later. Keep existing messages and photographs in their original form. Do not edit or delete an earlier message because its wording now seems unhelpful.
Preserve the surrounding evidence
Save the collision photographs, witness details, incident number and relevant correspondence. Tell your attorney exactly what you said, to whom and why. For example, a person may have meant that they could get out of the vehicle, rather than that they had received a medical assessment. That distinction must come from the facts. Your attorney can compare the statement with the complete record and assess how an insurer might use it.
Get advice before making broad conclusions
Avoid guessing about long-term recovery, fault or settlement value during follow-up calls. Ask what information is being requested and obtain advice about your obligations under any applicable policy. A truthful, consistent history is more useful than a rehearsed answer. Bring the original records and your concerns to a consultation so the statement can be evaluated alongside the injury evidence.
