MRI Shows Degenerative Changes: Do You Still Have a California Injury Case?

by | Nov 5, 2026 | Damages, Personal Injury, Videos

No. An MRI report mentioning degenerative changes does not automatically mean you have no California personal injury case. The important question is whether the accident caused a new injury or made an existing condition worse. That requires looking at your symptoms, medical history, examinations and medical opinions together.

What does the insurance company’s argument actually establish?

After an accident, an adjuster may point to words such as “degenerative” or “preexisting” in your MRI report and argue that your symptoms have nothing to do with the incident. Those words deserve medical attention, but they do not answer every question about responsibility. Nor does the discovery of a disc bulge or herniation automatically establish that a crash caused it.

Ask your treating clinician to explain the report in the context of your own history. Avoid diagnosing yourself from a single phrase. The timing of symptoms, prior treatment, examination findings and any earlier imaging can all help frame a meaningful evaluation.

California law distinguishes an old condition from additional harm

California Civil Jury Instruction 3927 distinguishes a condition that existed before wrongful conduct from the worsening that conduct caused. A defendant is not responsible simply because an old condition exists, but damages may compensate for proven aggravation. Instruction 3928 separately addresses unusual susceptibility: being more vulnerable than a normally healthy person does not excuse a defendant from responsibility for harm the defendant caused.

These principles do not guarantee recovery. Responsibility for the incident, the connection between the conduct and claimed harm, and the nature and extent of the losses still require proof. The Judicial Council’s published California Civil Jury Instructions provide the relevant framework; the instructions that apply in a particular case depend on its evidence.

Build an accurate before-and-after timeline

A useful timeline describes your baseline and what actually changed. Be specific and truthful, including periods when you improved. An earlier episode of neck pain is different from ongoing symptoms that already required treatment, and your providers and lawyer need to understand the distinction.

  • Before the accident: list relevant diagnoses, earlier injuries, providers, medication, imaging, symptoms and activity restrictions.
  • After the accident: record when symptoms began or worsened, where you felt them, and how they affected sleep, work and ordinary activities.
  • During treatment: retain visit summaries, referrals, test reports, bills and written work restrictions. Note treatment gaps and the actual reasons for them.
  • Other events: disclose later accidents or other developments that might affect the medical picture.

Do not hide an earlier injury or assume your lawyer will find every record without your help. Give the office the provider names and dates you know, even when a record may seem unfavorable. A complete history allows an informed assessment.

Preserve the imaging as well as the written report

Keep copies of the MRI report and ask the imaging facility how to obtain the actual study. Preserve relevant earlier studies if available. A medical professional may need to compare images rather than rely only on the wording of two reports. Keep the original files intact and avoid adding annotations to the only copy.

Also preserve photographs, incident reports, witness information and communications about the accident. Imaging concerns the medical issues; it does not replace evidence about how the incident happened. Review broad requests for medical authorizations with your attorney so you understand their scope and the proper response.

Common questions about degenerative findings

Can I have a claim if I had symptoms before the accident?

Possibly. The evaluation focuses on whether the incident caused additional harm and what evidence supports that change. Prior symptoms should be disclosed, not minimized or concealed.

Does an MRI prove when a disc injury occurred?

Do not assume that it does. Ask a qualified medical professional what can and cannot be concluded from your particular study, prior records and clinical history.

Should I stop treatment because the adjuster calls my condition preexisting?

Discuss treatment decisions with your healthcare provider. An insurance argument is not a substitute for medical advice. Tell your provider if you have concerns about treatment, cost or access, and keep your attorney informed.
