Choosing a California personal injury lawyer means choosing who will investigate your accident, explain your options and stand beside you when an insurance company disputes the claim. Before signing, look beyond an advertisement. Ask about relevant experience, trial preparation, direct attorney access, written fees and the lawyer’s State Bar record. In the video above, attorney Norman Gregory Fernandez discusses what to look for before hiring counsel.
1. Experience with the kind of injury case you have
A rear-end collision, a fall on unsafe property and an accident involving a commercial vehicle can raise different evidence and insurance questions. Ask whether the lawyer regularly handles your type of case and what issues need investigation. A useful consultation should address the facts you know, the evidence still missing and the next practical steps.
Years in practice can be relevant, but they are one part of the evaluation. Ask who will review your medical records, preserve photographs and identify responsible parties. Be cautious about anyone assigning a guaranteed value before understanding liability, injuries and available coverage.
2. Preparation for litigation and trial
Many claims resolve through negotiation, but a disputed case may require a lawsuit, discovery, expert testimony or trial. Ask about the attorney’s experience handling contested cases and how the firm decides whether litigation makes sense. The answer should include the potential benefits, expenses and uncertainty.
A lawyer’s willingness to explain weaknesses is useful. No attorney can promise that a case will settle for a particular amount or produce a successful verdict. Good preparation starts with evidence and a realistic assessment.
3. Access to the attorney handling your case
Find out who will actually represent you. Ask whether the lawyer you meet will remain involved, how you can contact that lawyer and how the office communicates important developments. Staff can provide valuable support, but you should understand who makes legal recommendations and answers your substantive questions.
Discuss your preferred method of communication and any language or accessibility needs. Clear expectations early can prevent frustration when treatment continues or negotiations take longer than expected.
4. A clear written explanation of fees and costs
Read the fee agreement before signing. Ask how the attorney’s fee is calculated, how case expenses are handled, whether the percentage changes at different stages and what happens if there is no recovery. Attorney’s fees, litigation expenses and medical reimbursement obligations are different items.
A settlement figure is not necessarily the amount you receive. Ask the lawyer to explain how deductions could affect your net recovery. The State Bar of California provides consumer resources about working with attorneys and checking a lawyer’s record.
5. Verify the license and make an informed choice
Use the State Bar’s attorney search to verify the individual lawyer’s license status and review available disciplinary information. Confirm the identity of the law firm entering the agreement. An impressive website or large advertising budget is not a substitute for knowing who represents you.
Bring accident information, photographs, insurance correspondence and available medical records to the consultation. You do not need every document before asking for help. Ask about time-sensitive evidence and deadlines promptly.
