A vacation rental injury in California can involve more than a conversation with the person who accepted your booking. An unsafe stair, loose railing, damaged walkway or other condition may require an investigation into who owned, maintained and controlled the property. Renting through Airbnb or another platform does not by itself identify the person legally responsible.
In this video, attorney Norman Gregory Fernandez explains the questions that can matter after an injury at an Airbnb or vacation home.
Identify the condition that caused the injury
Start with what happened. Describe where you were, what you were doing and the specific condition involved. A fall alone does not establish negligence. Photographs taken before a repair can help show the condition, its location and the surrounding area.
If it is safe, photograph both close details and wider views. Preserve original files. Ask witnesses for contact information and write down what you remember while it is fresh. Do not recreate the accident or put yourself at risk to obtain evidence.
Ownership, management and control may differ
The listing host may be the owner, a tenant or a property manager. Maintenance and cleaning may be handled by separate businesses. An attorney may need to identify who had responsibility for the area and who could inspect or correct the condition.
California premises liability generally requires proof of negligence connected to the property and resulting harm. Relevant questions can include how the condition arose, whether someone knew or reasonably should have discovered it, and whether reasonable steps were taken. The roles of each person or business must be evaluated individually.
Save the listing and reservation records
Keep your confirmation, payment receipt, property address, listing photographs, check-in instructions and the host’s contact information. Save messages about maintenance issues, warnings or earlier complaints. A listing can change after a booking, so preserve the version available to you rather than relying on a link alone.
For example, a message reporting a loose handrail before a fall may help establish a timeline. A photograph from your arrival may show a condition before anyone altered it. Neither item guarantees a successful claim, but each can help the investigation.
Report accurately and preserve responses
Promptly report the incident to the appropriate host or manager and keep a copy. Describe the facts you know without guessing about the cause or assigning blame prematurely. Save acknowledgments, incident numbers and communications from the booking platform or an insurer.
Do not assume that submitting a platform report files a lawsuit or protects every legal deadline. An insurance inquiry and a legal claim can involve different requirements. Bring any proposed release or settlement paperwork to your attorney before signing.
Insurance needs its own review
Ask an attorney to investigate potentially applicable coverage. A homeowner policy, rental-related policy or other arrangement may need review, and exclusions or conditions can matter. A platform’s name on the reservation is not a promise that it will compensate you.
Avoid relying on a general statement that the property is insured. The relevant questions include who is insured, what activity is covered and whether the policy applies to the incident. Responsibility for an injury and the availability of insurance are separate issues.
Document your medical care and losses
Obtain appropriate treatment and give providers an accurate account of the injury and relevant history. Keep medical records, bills, receipts and documentation of missed work. Tell your attorney if you live outside California or left the rental before evidence could be collected.
