The Store Cleaned Up the Spill: Can You Still Prove a California Fall?

by | Oct 23, 2026 | Personal Injury, Slip and Fall / Premises Liability, Videos

A store cleaning up a spill after a fall does not automatically end an injury claim. It can make the scene harder to document, so prompt preservation of other evidence matters. Cleanup by itself does not prove that the store was negligent before the accident.

Attorney Norman Gregory Fernandez explains in this video why a changed scene still calls for a careful investigation.

Document what you actually observed

Write down the location, approximate time and what you saw before and after falling. Describe the liquid or substance only if you can do so accurately. If you saw an employee clean it up, record that observation without assuming how long the spill existed beforehand.

Photographs taken after cleanup can still help identify the area, nearby displays, camera locations and lighting. Label their timing honestly. Do not recreate a spill to photograph what you think the scene looked like.

Ask promptly about surveillance

Relevant footage may show the condition, the fall, employee activity or the time before the incident. Ask that the appropriate footage be preserved and provide enough location and timing information to identify it. A store may not voluntarily release video simply because you request it. An attorney can evaluate appropriate preservation and evidence requests.

Look beyond the floor photograph

Witnesses, an incident report, receipts, employee observations and inspection records may help reconstruct events. Obtain witness contact information with permission. Keep any photographs, messages or clothing that may be relevant. Preserve originals and do not edit them misleadingly.

Notice remains a separate question

California premises liability can involve whether the business created a dangerous condition, knew of it or should have discovered it through reasonable care. The fact that someone cleaned up afterward does not alone answer those questions. The available records and testimony need to be evaluated together.

Legal rules may also affect whether evidence of a later safety measure can be used for a particular purpose. Do not assume every repair or cleanup is an admission of fault.

Take care of your health and obtain advice

Seek appropriate medical care and explain the incident accurately. Keep treatment information, bills and records of missed work. Bring your timeline, report details and photographs to a consultation. Even without a perfect scene photograph, an investigation may identify useful evidence; no attorney can promise the result before reviewing it.

General information, not legal advice. Every case depends on its facts. No result is guaranteed. An attorney-client relationship requires an agreed engagement.
