You Did Not See the Hazard Before Falling: California Injury Claims

by | Oct 23, 2026 | Personal Injury, Slip and Fall / Premises Liability, Videos

Not seeing a dangerous condition before a fall does not automatically make the accident your fault. It also does not automatically make the property owner responsible. A California premises injury investigation considers the condition, visibility, reasonable care and how the incident happened.

Attorney Norman Gregory Fernandez discusses the issue in the video above. The most useful starting point is an accurate description of the scene.

Describe what was visible from your path

A close photograph taken after a fall may not show what a person could see while approaching. If safe, preserve both close views and wider photographs from the direction you walked. Note lighting, shadows, flooring patterns, obstructions and whether merchandise or people blocked the view. Record the time because lighting conditions can change.

Identify the cause without guessing

Describe what you felt and what you observed afterward. A wet surface, raised edge and loose object require different investigations. If you cannot identify the cause, do not invent one. Witnesses, video and an inspection may provide information you did not have immediately after the accident.

Preserve shoes and relevant photographs in their original condition. Write down the location precisely enough that someone can identify the area later.

Visibility is part of a broader legal analysis

California law considers reasonable care by the people involved. An obviously unsafe condition can affect the duties at issue, but the analysis depends on circumstances, including whether harm should still have been anticipated. An allegation that you should have noticed something is not a complete factual investigation.

Comparative fault may also be disputed. Explain honestly what you were doing, carrying and looking at. Do not conceal unfavorable facts from your attorney; they need the complete account to evaluate the case.

Ask for evidence to be preserved

Report the incident, obtain witness contacts and request preservation of surveillance and inspection records. A business may change the area quickly for safety reasons. Do not interfere with cleanup or create a second hazard to document the first one.

Get a case-specific assessment

Seek appropriate medical attention and keep records of treatment and losses. Bring scene photographs and a truthful timeline to a consultation. The question is not simply whether you saw the hazard; it is whether the evidence establishes a negligent condition that caused injury and how each person’s conduct fits the circumstances.

General information, not legal advice. Every case depends on its facts. No result is guaranteed. An attorney-client relationship requires an agreed engagement.
