California Dental Malpractice Cases

Dental Malpractice in the State of California occurs when a doctor, dentist, Dental facility, or other Dental provider fails to act as an ordinary professional in the same community would under similar circumstances.

Another way of looking at California Dental Malpractice is that if a dentist makes a mistake that an ordinary dentist in the same community would not make under the same conditions, this would also be malpractice.

For instance, if a dentist extracts the wrong tooth, or is a dentist drops a drill down the throat of a patient, this would be dental malpractice.

Often times Dental Malpractice is not as easy to prove as the example given above, but the example is meant as a way to illustrate what these types of cases are.

Forced Arbitration For Dental Malpractice

California allows health care providers and their patients to contract for the arbitration of disputes. However, absent the parties’ agreement, California does not require that claims of Dental malpractice be arbitrated prior to litigation.

Most HMO Plans in California have an Arbitration clause built in which takes your case out of the normal court system, and forces it to be tried in front a private neutral arbitrator who is agreed to by the parties.
